Pennsylvania High Court Will Review Mask Sales Tax Cases

The Supreme Court of Pennsylvania announced Tuesday it will review a proposed class action alleging that Foot Locker Inc., American Eagle Outfitters Inc., The Gap Inc., and other retailers violated state law by charging sales tax on cloth face masks.

The high court will examine an appeals court dismissal of a lawsuit alleging the retail companies violated Pennsylvania’s Unfair Trade Practices and Consumer Protection Law by collecting sales tax on exempt cloth face masks. The lower court said in a pair of opinions that such a suit can’t be brought under the UTPCPL.
