Indiana DOR Sustains Taxpayer’s Protest Regarding Vehicle Trust Transfer

The Indiana Department of Revenue (DOR) issued a ruling regarding the taxpayer’s use tax for the year 2023. The taxpayer, an Indiana resident, purchased a new vehicle and transferred ownership to a living trust. The Department initially assessed use tax based on the vehicle’s average selling price. Upon protest, the DOR determined that the taxpayer did not owe use tax on the transfer of the vehicle to the trust, as the taxpayer was both the grantor and trustee, and no sale or consideration was exchanged.
