A federal appeals court enforced a National Labor Relations Board order requiring a Las Vegas casino to bargain with a union, though not based on both precedents that the agency sought.
The US Court of Appeals for the District of Columbia Circuit on Wednesday endorsed the board’s bargaining order against Red Rock Casino Resort Spa under NLRB v. Gissel Packing Co., a 1969 US Supreme Court opinion authorizing such directives when labor law violations likely prevent a fair rerun election.
