Discover Financial Services’ former global payments network head can pursue claims that age and sex bias caused the cancellation of roughly $8 million in incentive compensation she was due, a Chicago federal judge ruled.

Discover’s seemingly novel arguments that Diane Offereins’ lawsuit misused pension status as a proxy for age and that the incentive compensation didn’t count as “wages” under the Equal Pay Act were rejected by the US District Court for the Northern District of Illinois.
