The Department of Justice agreed to pay $440,000 to settle a disparate impact lawsuit with an older female psychiatrist who alleged that the required physical abilities test for the Bureau of Prisons discriminated against her age.
Jane DiCocco said that the BOP forced her to resign after she reported she couldn’t pass the test if she retook it within 24 hours after her initial failure per the agency’s policy. The parties asked Judge John A. Gibney to dismiss the case Tuesday.
