Full Fifth Circuit Weighs Planned Parenthood Immunity Claim (1)

The full Fifth Circuit struggled with immunity for private lawyers in a case over advice from Planned Parenthood attorneys.

Members of the en banc court on Thursday pressed a lawyer for the group about whether his client should be immune from a whistleblower lawsuit, if its attorneys were part of the alleged fraud.

The whistleblower, known as “Alex Doe,” has alleged that Planned Parenthood affiliates in Louisiana and Texas were continuing to bill Medicaid despite the states terminating their eligibility to do so, in violation of the False Claims Act.
