Home care workers failed to show that a company acting as an intermediary between them and Medicaid recipients functioned as their joint employer, dooming their overtime claims, the Third Circuit ruled.
Public Partnerships LLC lacked significant control over the workers’ jobs because it doesn’t have the final say over their day-to-day functions, compensation, or hiring and firing, the US Court of Appeals for the Third Circuit said Tuesday in an unpublished opinion.
