Insurance Trade Group Backs Carriers in Publix Opioid Appeal

An insurance industry group is throwing its weight behind liability carriers in a dispute over coverage for claims alleging Publix Super Markets Inc. contributed to the opioid epidemic.

The insurance policies sold by units of Chubb Ltd., Berkshire Hathaway Inc., and other carriers don’t cover “generalized financial losses untethered to specific, individualized bodily injury,” the Complex Insurance Claims Litigation Association said in a proposed amicus brief filed Wednesday in the US Court of Appeals for the Eleventh Circuit.
