A home health company remains liable for over $7 million after the US Supreme Court denied its review request of a decision that found it illegally withheld workers’ compensation for travel time between its office and client sites.
The justices Monday left in place the US Court of Appeals for the Third Circuit ruling that Philadelphia-based healthcare provider Nursing Home Care Management Inc., which does business as Prestige Home Care Agency, must pay more than $3.5 million in back wages and an equal amount in liquidated damages for violating the Fair Labor Standards Act’s overtime provisions.
