Construction products manufacturer Summit Materials LLC requested expedited proceedings against several senior employees for allegedly threatening to breach their contracts by establishing a competing business.
Summit sued in the Delaware Chancery Court seeking injunctive relief against Robert Hall and four of his associates after they asked a Texas court on March 15 to invalidate the non-competition and non-solicitation clauses in their contracts. Summit claims the defendants “would not have filed the Texas action unless they had already started, or intended to start, violating their restrictive covenants.”
