Tesla Must Face Applicant’s Citizenship Bias Claims, Judge Says

Electric vehicle manufacturer Tesla Inc. failed to convince a federal judge to toss claims that it discriminated against US job applicants in favor of workers on H-1B visas.

Judge Vince Chhabria of the Northern District of California said he was “somewhat skeptical” of plaintiff Scott Taub’s allegations that he wasn’t considered for an engineering role because of a preference for H-1B workers. But he found in a Feb. 23 order that Taub’s complaint “pled just enough facts” to allege the Elon Musk-owned company discriminated against US citizens.
