Texas Tech Must Face Obese Doctor’s Wrongful Termination Lawsuit

Texas Tech University Health Sciences Center must face an employment discrimination suit brought by a first-year resident who alleges she was fired because of her obesity, after a state court of appeals affirmed a lower court’s ruling.

The Texas Court of Appeals, Eighth District agreed with the trial court’s decision to deny Texas Tech’s motion to dismiss the matter before trial. It rejected the school’s argument that morbid obesity is not considered a disability under the Texas Commission on Human Rights Act.
