7-Eleven Gets Health Plan Tobacco Penalty Suit Moved to Texas

7-Eleven Inc. scored a court order transferring litigation over its health plan’s tobacco penalty to a federal court near its corporate headquarters outside Dallas.

Judge William S. Stickman IV on Wednesday granted the convenience store chain’s motion to transfer the dispute away from his courtroom in the US District Court for the Western District of Pennsylvania. 7-Eleven’s health plan includes a valid forum selection clause requiring that litigation be brought in the Northern District of Texas, Stickman said.
