Husch Blackwell Defends 401(k) Process From Ex-Partner’s Lawsuit

Husch Blackwell LLP sought dismissal of a proposed class action over its 401(k) plan, saying the former partner who filed suit understood and agreed to the plan’s terms and failed to raise the matter internally.

The law firm properly deposited all employee contributions to its 401(k) plan within the timeframe established by law, Husch Blackwell said in a motion to dismiss filed Monday in the US District Court for the Western District of Missouri. The case’s allegations of delayed 401(k) deposits are premised on a misunderstanding of employee contributions and those funded by an employer, the firm said.
