Bay Street Advisors, LLC ‘s motion to dismiss a former partner’s breach of a quasi-contract counterclaim that Bay Street failed to pay him agreed upon commission for completed client work under a resignation transition plan and agreement was sufficiently pled, a federal district court in New York ruled, while also denying Bay Street’s motion to strike allegations in his counterclaims which were relevant to his case and not unduly prejudicial.
