Jani-King Beats Class Action Over Worker Misclassification

A Connecticut federal court tossed class claims for unjust enrichment based on worker misclassification brought by over 100 commercial-cleaning workers nationwide.

The franchisees sufficiently alleged that they were misclassified as independent contractors under Connecticut’s three-prong worker classification test, but didn’t have enough evidence to demonstrate that the franchisor was unjustly enriched by receiving franchise fees, Judge Victor Bolden of the U.S. District Court for the District of Connecticut found Dec. 21.
