National Guard Member Fired From Job Loses Military Bias Trial

A former county employee in Tennessee failed to convince a federal jury he was unlawfully fired because he took leave to attend National Guard training.

Skylar Wamsley, who worked for the Bedford County Juvenile Detention Center, didn’t prove discrimination or retaliation under the Uniformed Services Employment and Reemployment Rights Act, a US District Court for the Eastern District of Tennessee jury found Tuesday.

The case is one of few USERRA disputes to reach trial each year. The 1994 law prohibits job bias against workers who serve in the armed forces and provides reemployment rights for service members.
