North Carolina Landowner Appeals Initial Loss in Wetlands Suit

North Carolina landowner Robert D. White is challenging a judge’s denial of a preliminary injunction against the Biden administration’s wetlands rule that was a response to the Supreme Court’s ruling in Sackett v. EPA.

Judge Terrence Boyle of the US District Court for the Eastern District of North Carolina on June 18 denied White’s motion seeking to block the rule defining waters of the US, or WOTUS, which was finalized in 2023. White filed a notice of appeal Monday to the US Court of Appeals for the Fourth Circuit challenging the denial as the original lawsuit continues in district court. ...
