Napoli Shkolnik Defeats Female Chinese Lawyer’s Job Bias Lawsuit

A female Chinese American attorney won’t get a bias trial against Napoli Shkolnik PLLC and two former principals over her demotion and termination because she failed to timely participate in discovery and missed other deadlines.

The decision Monday by the US District Court for the Southern District of New York serves as a warning regarding the risks of not complying with court-ordered dates or federal rules governing extension requests.

Summary judgment was proper on former department head Selma Moy’s claims against the firm and Paul and Marie Napoli given her transgressions, Judge Dale E. Ho said.
