Santa Clara County’s lawsuit challenging the constitutionality of the Trump administration’s executive order ending birthright citizenship may be put on pause pending an appeal in a nearly identical case.
Judge Eumi K. Lee of the US District Court for the Northern District of California canceled a preliminary injunction hearing set for Thursday in San Jose, Calif., telling the parties that she instead wants to know why she shouldn’t stay the case.
She pointed to an existing injunction issued by a federal judge in Seattle on Feb. 6 blocking the executive order—the same relief that’s been requested by Santa Clara.
