Yorktown’s Injunction Affirmed Against Army Contract Partner

Defense contractor Yorktown Systems Group Inc. properly received injunctive relief in its dispute with US Army contracting partner Threat Tec LLC, the Eleventh Circuit affirmed Friday.

Yorktown and Threat Tec formed a joint venture, whereby Yorktown was the mentor in the companies’ mentor-protégé arrangement under the Small Business Administration program. The joint venture won a $165 million contract for intelligence and IT support in July 2020. The “relationship hit the rocks,” and Yorktown sued Threat Tec—the joint venture’s managing member—for breach of fiduciary duty, alleging that Threat Tec was attempting to steal work under the contract.
