Closure of Leaking Coal Ash Pit Will Cause Harm, Group Says

Mobile Baykeeper Inc. has been and will continue to be harmed by pollution stemming from a coal ash impoundment that doesn’t comply with federal storage standards, even if it’s closed, the group said in a brief to a federal appeals court.

Alabama Power Co. “is implementing an illegal closure that will permanently leave millions of tons of coal ash and toxic pollutants sitting in groundwater in an unlined impoundment on the banks of the Mobile River,” the environmental group said in its brief filed with the US Court of Appeals for the Eleventh Circuit on Tuesday.
