An electric generation facility operator in Ohio is challenging the Environmental Protection Agency’s denial of its request to extend the deadline for its coal combustion residual impoundment to stop receiving waste.
Gavin Power LLC told the US District Court for the Southern District of Ohio on Thursday that the agency’s denial was based on new nationwide requirements that didn’t comply with the procedures required by the Resource Conservation and Recovery Act and the Administrative Procedure Act.
