A federal judge rejected an identity security company’s attempt to disqualify Morrison & Foerster from representing a rival in a patent infringement lawsuit, ruling that the firm’s limited early involvement in the case didn’t merit a disqualifying conflict.
Judge Ria F. Lin for the US District Court for the Northern District of California denied FaceTec Inc.'s motion Tuesday, finding a lack of evidence showing Morrison & Foerster acted as co-counsel with the already ousted firm Perkins Coie. FaceTec argued both firms should be removed over a conflict since both appeared on the docket during early stages of the dispute.
