Federal Judge Declines to Pause Illinois Generic Drug Price Law

Illinois can continue enforcing its law allowing penalties on generic drug manufacturers for excessive price increases while litigation over the law plays out, a federal judge said Friday.

The Association for Accessible Medicines, which represents the generic drug and biosimilars industry, hasn’t clearly demonstrated that it’s likely to succeed with its claim that the Illinois law is unconstitutional by directly regulating prices charged in transactions that take place outside of Illinois, Judge Virginia M. Kendall of the US District Court for the Northern District of Illinois wrote in her ruling denying AAM’s renewed motion for a preliminary injunction.
