Judge Dings Life Spine Filing in $9.5 Million Globus Patent Case

A Delaware judge declined to revisit how a $9.5 million verdict for Globus Medical Inc. counted infringing sales in its patent win over Life Spine Inc., saying the defendant didn’t point to where in the trial record experts agreed.

Chief Judge Colm F. Connolly said in an oral order issued Wednesday in the US District Court for the District of Delaware that he didn’t consider Life Spine’s claim that both sides’ experts agreed on 62,942 infringing units when reviewing the parties’ proposed judgments because Life Spine hadn’t cited where that statement appears in the trial record.
