Peloton Escape from ‘Bike+' Trademark Suit Appealed by App Maker

A workout app maker appealed Peloton’s victory over its lawsuit claiming the interactive stationary-bike maker infringes its “Bike+" trademark, according to a Monday filing in California federal court.

World Champ Tech LLC is asking the US Court of Appeals for the Ninth Circuit to overturn a ruling that it’s unlikely consumers would associate its app’s “weak” mark with “Peloton Bike+" bikes. Despite the relatedness of bikes and workout apps, World Champ hadn’t marketed its descriptive mark in years, the US District Court for the Northern District of California said in its February order granting Peloton Interactive Inc. summary judgment.
