Skeptical Court Gives Parents Second Chance With PFAS Claim (1)

A federal court will dismiss a requested class action alleging a children’s clothing company violated consumer law by failing to disclose PFAS in its products unless the parents making that claim provide more evidence.

Plaintiffs by April 23 must ask the court to amend their complaint and provide “at least one viable claim over which the court has jurisdiction” or the court will enter judgment against them, Judge Matthew F. Kennelly, of the US District Court for the Northern District of Illinois, wrote in a memorandum and order issued on Monday.
