Supreme Court Declines to Weigh Dispute Over FERC’s Authority

The US Supreme Court on Tuesday declined to consider a challenge to the Federal Energy Regulatory Commission’s authority from a property-owning company, a case that could have tested the high court’s view of agency deference post its Loper Bright decision.

RDFS LLC—which owns the property that Columbia Gas Transmission LLC’s natural gas pipeline runs under—petitioned the US Court of Appeals for the Fourth Circuit for review of FERC’s decisions to issue a blanket certificate for a natural gas pipeline and deny the company’s motions for rehearing.
