US Customs, ITC Push to Toss Masimo’s Apple Watch Import Lawsuit

Masimo Corp.'s lawsuit to block Apple Watch imports should be dismissed because Congress gave the US International Trade Commission—not district courts—authority over such disputes, and because Masimo can’t show irreparable harm, US Customs and Border Protection and the ITC said.

The agencies made their arguments in briefs filed Wednesday in the US District Court for the District of Columbia supporting their motions to dismiss and opposing Masimo’s requests for a temporary restraining order and a preliminary injunction.
