New Class Actions Target PBM-Run Drug Cost Savings Programs

Prescription cost-saving programs teamed up with pharmacy benefit managers including Express Scripts Inc. and CVS Health Corp.-run Caremark Rx LLC are inflating specialty medication co-pays to siphon off drug company assistance, according to a pair of new federal lawsuits.

The class-action complaints filed in the US District Courts for the Northern District of New York and District of Rhode Island accuse PBMs and their affiliated programs of preying on vulnerable patients with serious chronic health conditions by flouting statutory cost-sharing limits and burdening patients who have to shoulder other health-care costs.
