Fifth Circuit judges appeared skeptical in a hearing of SkyWest Airlines Inc.'s request for a new trial in a sexual harassment case due to what the airline has said was the EEOC’s misuse of text messages as evidence.
An attorney for SkyWest during an oral argument Monday asked the US Court of Appeals for the Fifth Circuit to overturn a Texas federal judge’s ruling denying the airline’s request for a new trial in the case brought by the Equal Employment Opportunity Commission and former Sky West maintenance facility employee, Sarah Budd, who is an intervenor.
