A Department of Homeland Security proposal to restrict the duration of foreign students’ tenure in the US has cleared White House review, the final step before its public release.
F-1 student and J-1 exchange visitor visa holders are allowed under current regulations to stay in the US for the duration of an academic program or internship. If finalized, the new regulation would restrict their legal status to a fixed period of time before they are required to apply for renewal—potentially before the completion of their studies. DHS sent the proposal (RIN: 1653-AA95) to the White House Office of Information and Regulatory Affairs on June 27 and review concluded Thursday.
A 2020 Trump administration proposal would have limited student and exchange visitors to fixed periods of two or four years depending on their area of study. That proposed rule, which was withdrawn by the Biden administration, was criticized by higher education groups for creating needless disruption to academic programs.
