Florida Law Firm Defeats Class Action Over May Data Breach

Florida law firm Zumpano Patricios PA no longer faces a data breach complaint brought by a Florida resident who said he was a victim of a 2025 cybersecurity incident caused in part by the law firm’s negligence.

The proposed class action can’t proceed because named plaintiff William Manning lacks standing, the US District Court for the Southern District of Florida ruled.

An increased risk of identity theft or fraud is too speculative by itself to describe a constitutional injury, and so are mitigation efforts to tackle that hypothetical threat, Judge Beth Bloom said. Anxiety caused by a data breach must ...
