FTC Victory Against Fuel Card Company Largely Upheld on Appeal

A district court’s summary judgment ruling against a business payments company was mostly affirmed Tuesday after a federal appeals court held it used deceptive advertising practices in its fuel card program.

Judgment in favor of the Federal Trade Commission on five counts of violations of the FTC Act by Corpay Inc. was upheld by the US Court of Appeals for the Eleventh Circuit. One count of summary judgment against Corpay CEO Ronald Clarke was vacated, but the appeals court affirmed the remaining four FTC Act violations.
