A securities broker is asking the D.C. Circuit to overturn a lower court order rejecting his challenge to the power of FINRA to pursue him for alleged ethics violations.
Broker Eugene H. Kim contends the Financial Industry Regulatory Authority exercises power unconstitutionally.
Kim and the authority on Monday obtained a district court stay of the case while his US Court of Appeals to the D.C. Circuit challenge proceeds, contending that an already-pending appeal brought by Alpine Securities Corp. will likely resolve most of the issues.
