A circuit split over the rights of transgender inmates deepened in October, with a divided Second Circuit panel holding that they don’t have a clearly established right to receive care from gender-dysphoria specialists or get related specific treatments.
Connecticut inmate Veronica-May Clark said they didn’t receive the appropriate treatment from the prison system, but the US Court of Appeals for the Second Circuit ruled that state officials were protected by qualified immunity because some care was provided.
