A federal judge on Monday dismissed a lawsuit seeking to hold former New York Gov. Andrew Cuomo (D) liable for nursing home deaths that occurred during the Covid-19 pandemic.
“As explained herein, and despite the Court’s deepest sympathy for Plaintiffs and their families, the fact remains that their proffered claims are not legally viable,” US District Court for the Southern District of New York Judge Katherine Polk Failla wrote in her opinion.
Failla dismissed the plaintiffs’ federal civil rights claims with prejudice. She dismissed the remaining claims, including those brought under state law, without prejudice.
