Alcatel-Lucent’s Patent Loss Vacated by Federal Circuit

CMS Technologies Inc. saw its patent infringement win against ALE USA Inc. vacated Sept. 19 after the Federal Circuit determined the case was still “pending” after the Patent Trial and Appeal Board issued an intervening decision invalidating the underlying patents.

The case hadn’t been closed because ALE could still request modifications of the decision and award against it, the U.S. Court of Appeals for the Federal Circuit held in an unpublished ruling.
