BGOV Bill Summary: H.R. 1631, Standards Copyright Protection (1)

Private developers of consensus industry, building, and safety standards would be allowed to maintain their copyright even if the standard has been incorporated into a public law or regulation under H.R. 1631.

Standards developers could retain exclusive copyright on commercial versions of codes or standards referenced by federal, state, or local laws or regulations by making them publicly accessible online in a searchable format. Developers also could require users to create an account or agree to terms of service as a condition of accessing information, but they couldn’t impose a cost or collect personally identifiable information.
