A federal district court in Florida denied a professional wrestler’s estate’s motion for a preliminary injunction in this copyright infringement action against a radio personality and former friend of the wrestler, seeking to prevent the friend’s comments in violation of a settlement agreement and to prohibit distribution of a documentary that allegedly contains excerpts of a sex tape. The court determined that the estate didn’t show a substantial likelihood of success on the merits because the documentary’s use of the sex tape is likely to be a fair use.
