The District of Delaware denied Jazz Pharmaceuticals Inc.'s motion for summary judgment on Avadel CNS Pharmaceuticals LLC’s counterclaims alleging violation of the Sherman Act by listing and refusing to delist in the Orange Book a patent that discloses a sensitive drug distribution system and method. The court denied Jazz summary judgment of no antitrust standing and no antitrust liability.
