A federal district court in California granted in part and denied in part Sugarfina Inc.'s renewed motion for summary judgment on Global Apogee’s action for trademark infringement, unfair competition, and service mark infringement, relating to “Candygram” marks. According to the court, there is no infringement based on the use of “Candygram” because that term is generic, but genuine disputes of material fact exist on the question of whether the use of “Candy[Envelope]Gram” infringed on Global Apogee’s registered “Candy-Gram” mark.
