Judge Declines to End 28-Year Migrant Child Detention Agreement

A judge declined to end a decades-old settlement governing the treatment of migrant children in federal custody, finding the Trump administration failed to identify any new facts or law to justify it.

Federal regulations are still inconsistent with the 1997 Flores settlement, Judge Dolly M. Gee of the US District Court for the Central District of California said in a Friday order. The agreement requires immigration officials to hold children in “safe and sanitary” facilities, limit how long they can be detained, and release them to family members when possible.
