Louis Vuitton Brings Trademark Claims Against Casino Company

Louis Vuitton sued PPE Casino Resorts Maryland LLC, which does business as Live! Casino & Hotel, for allegedly using the legendary French fashion house’s brand, trademarks, and goodwill in an effort to create a false association between the luxury fashion designer and the casino chain.

Specifically, Louis Vuitton said its monogram trademark and several stylized floral design trademarks were used in a “luxury bag collection” that the casino company developed and advertised to its patrons as “The Art of Luxury.”

The complaint, filed Monday in the US District Court for the District of Maryland, says the collection also included items like backpacks and toiletry cases that intentionally mimic the color combinations, shapes, and designs of Louis Vuitton products.

Side-by-side images included in the complaint show the casino company’s design swaps Louis Vuitton’s “LV” logo for the word “Live!” while keeping the fashion brand’s signature flower pattern around it.

Casino customers were not informed that these items were not authentic Louis Vuitton products or that the campaign was unaffiliated with the luxury brand, the complaint says.

Both PPE Casino Resorts Maryland LLC and another defendant, the Cordish Companies Inc., didn’t immediately respond to a request for comment.

Louis Vuitton says it sent a cease-and-desist letter in April. The casino company agreed to stop distributing the products, but failed to provide the requested accounting of the items or information about its subsequent marketing campaign, the complaint alleges.

The second campaign included another line of products that Louis Vuitton alleges was presented as an authentic Louis Vuitton collection. Promotional materials for the line told customers they could win a “luxury French Collection,” and included images of a duffel bag, a belt, and sunglasses, according to the complaint.

The fashion house alleges the casino chain has continued to use its trademarks to deceive the public and that the infringement is willfull.

Louis Vuitton asserts federal claims for trademark counterfeiting, infringement, false association, and dilution, alongside a claim for unfair competition under Maryland law.

The complaint seeks preliminary and permanent injunctions against the alleged infringement and other alleged violations of Louis Vuitton’s intellectual property rights, a court order requiring destruction of the allegedly infringing products, an order requiring the casino chain to engage in corrective advertising, damages, and attorneys’ fees.
