Norton Nurse Lacks Proof of Cancer Bias, Kentucky Top Court Says

Norton Healthcare Inc. defeated a nurse’s bid to revive her lawsuit alleging that her termination was disability bias caused by her breast cancer and related treatment.

The ruling Thursday by the Kentucky Supreme Court declined to address an open issue of state law on which an intermediate appeal court decided the case. Further review was granted to decide whether the disability discrimination provisions of the Kentucky Civil Rights Act should be read consistent with subsequently enacted changes to the Americans with Disabilities Act, but there turned out to be no need “to resolve that question,” the state justices said.
