Patent Suits Against Amazon, Google Will Stay in California

The Federal Circuit denied a Canadian patent owner’s appeals of a pair of district court rulings that transferred infringement suits against Google LLC and Amazon.com Inc. from Midland, Texas, to Northern California.

In brief orders, Judge Kara F. Stoll wrote that VirtaMove “fails to cite any contrary cases” to challenge a 2023 Federal Circuit precedent that gives patent suit defendants an edge in moving certain types of infringement cases out of Texas courts where patent owners like to file. The court refused to abandon its own ruling, which VirtaMove argued contradicts the Fifth Circuit’s approach to transfers.
