Peloton Foe Seeks 9th Cir. Rehearing in ‘Bike+' Trademark Case

A biking app company asked the Ninth Circuit to rehear its trademark case against Peloton Interactive Inc., arguing the appeals court ignored key evidence and “subverted longstanding principles” when it affirmed the exercise company’s victory.

World Champ Tech LLC said in a Friday petition that the US Court of Appeals for the Ninth Circuit wrongly found a “Peloton Bike+" stationary bike trademark dissimilar from World Champ’s “Bike+.” The three-judge panel also ignored evidence that Peloton admitted the marks were likely to confuse consumers by enforcing its own mark, World Champ said.
