Thomson Reuters Enterprise Centre GmbH shot back at Ross Intelligence’s Third Circuit bid to escape a historic rejection of its fair use defense for training its AI tool on Westlaw headnotes.
Ross copied the legal summaries, which clearly qualify for copyright protection to train AI and create a competing legal research platform, Reuters told the US Court of Appeals for the Third Circuit. A district court rightly ruled out fair use, concluding Ross’s use wasn’t transformative because it created a commercial competitor in Westlaw’s market, Reuters’ Wednesday brief said.
