The Federal Circuit shot down Bot M8 LLC’s bid to revive claims from two video game patents that Sony Interactive Entertainment LLC successfully challenged at an administrative tribunal.
A three-judge panel of the US Court of Appeals for the Federal Circuit on Wednesday affirmed two decisions by the Patent Trial and Appeal Board finding claims in Bot M8’s US Patent Nos. 8,11,640 and 7,664,988—which cover a “Gaming Apparatus Having Memory Fault Detection"—to be obvious in light of prior art and therefore unpatentable.
